About me

Thalita Cavalcante Batista Silva is originally from Brasília, where she graduated in Legal Sciences from the Instituto de Ensino Superior de Brasília - IESB in 2010.

In 2013, she moved to Alto Paraíso de Goiás, in the Chapada dos Veadeiros, where she began working as a legal consultant for foreigners, focusing on residence visas. At that time, in response to the increase in demand from people buying real estate, she began working with legal advice on all stages of buying and selling rural properties, as well as working in the area of land regularization. She was one of those responsible for the first extrajudicial usucapião in the city of Alto Paraíso de Goiás.

In 2014, she completed a specialization in Environmental Law at UniSul and began a specialization in Sociobiodiversity and Sustainability in the Cerrado - UnB Cerrado.

In 2019, he arrived in Serra Grande - Bahia, to continue developing his work, expanding his practice to include the creation of conservation units in the region and the negotiation of forest assets.

You may have heard that Brazil is a country of continental dimensions and, to date, many properties have no real estate registration.

When it comes to public domain land, the government, after an administrative procedure and by discretionary act, grants the owner of the area a title deed.

This title must be registered at the competent registry office, which opens the real estate registry that converts the former possession into ownership

Judicial and Extrajudicial Usucaption

Usucaption is an original way of acquiring ownership of a property.

Original because ownership arises from a direct relationship between the agent and the property, with no legal relationship being established with the previous possessor/owner.

Thus, the purchaser acquires the property by the passage of time in which they exercise possession of the property, and the judgment is merely declaratory of this right.

Usucaption can be judicial or extrajudicial - carried out at a notary's office.

The creation of an RPPN is seen as one of the most important actions in environmental conservation. It is a sustainable use conservation unit and its creation is recorded on the property's registration and is therefore perpetual. Among the many benefits are the possibility of selling Environmental Reserve Quotas (CRAs), tax incentives and subsidies, as well as support from the environmental agency in managing the conservation unit.
